If you don't defend yourself at a hearing, preferably with a lawyer, it is almost inevitable you will lose. It is probably incorporated in Ohio, so they have hearings in Ohio. If they didn't, malcontent members (or shareholders in a stock corp.) could cause the expenditure of vast amounts of money holding hearings all over the country. Is it fair? Maybe, maybe not, depends on the circumstances. Unusual, no.

I'd love to the see the look on the IP and IBT face's if they were served with the lawsuit's summons and petition(complaint) at the Int'l in Gillette. Obviously, someone not a paper to the action would have to serve them. ;-)

Since when would common sense and world-wide recognized procedures deter special interest leadership from simply doing as they please?
Hang on... what?

First, Roberts has no such rule. In fact, teleconferences are explicitly allowed as long as all of the parties can hear each other.

Second, a quick perusal of the bylaws turned up no restriction that I can find. What section disallows teleconferences?

An update of general interest. It was reported at the Saturday meeting at Gillette that the legal expences to date have now topped $29,000.00 out of the $1,000.0o budgeted.

As noted above I am limited in what I can say at this point on advice of Counsel. Those that may want to follow what is happening on the other side might want to follow this thread.

appeal board decision

This link is to a letter from Region 2 prez and then links to the appeal board decision.

http://www.wbcci2.org/royjune10letter.htm

Sure looks like a frivolous grievance from here.

Rick,

Thanks for posting this. Apparently the leadership and the appeals board have forgotten the childhood rhyme "Sticks and stones can break my bones, but words can never hurt me".

It was asked earlier this week at the meetings in Gillette when do gripes become greivances. I am not certain of the woman who was speaking at the time during discussion but it made an impression upon me also. Usually if there is someone we can't see eye to eye with we just avoid the person or speaking to them. $29,000 later and the issues are no more settled than before the expenditure. Perhaps communication efforts can be employed with good result if employed in good intention.

I would have thought the new WBCCI forums a perfect venue for establishing communications and relationships but it never got off the ground with leadership.

The now PIP said he would spend it again!

He saved the club in so doing...his words.

Does that mean kicking Leo out saved the club? If so from what?

I guess he will feel even better when the club spends 5-10 times that $29,000 as defendants.

I think that generation prefers to hire out and not dirty their hands with personal dealings with mere people. So be it, that doesn't preclude a success on behalf of members however...

One of the first sentences in Carol's report of the proceedings in Gillette said, in effect, that because the loss in membership was less than last year's - then the club is responding positively to management's policies which have generated (at least this much) movement in a positive direction.

It is clear that everyone who renews his or her membership is counted as a vote for the IBT. There is no other way for the membership to express their opinions. Pay or not pay. There is no other vote or venue to effect change.

And that doesn't count the loss of members next year. I hate to say it, but between between Leo's expulsion and the dues increase I would not be at all surprised to see a thousand or more members not renew.

This is based on the number in my own unit (including unit officers) who have told me they aren't renewing. These aren't newbies who never participated in unit activities; these are people that make the unit work. WBCCI cannot afford to lose them.

I forget how large the club is at the moment. And I believe member ship is staggered as in not every one renews at the same time. So if 200 didn't renew in next 12 months I bet there would be some grumbling. If 400 didn't renew in the next 12 months it would be a statement. If 800 didn't renew I bet it might bring down the club.
