That will only work if the seller agrees to post the question/answer to the ebay listing. The seller has the option to not include questions/answers in the posting.

It's a bit suprising that he bought the domain name AFTER the anti-cybersquatting rules went into effect. What was he thinking?

When I saw the price, I though he was just goofing around.

Maybe he's looking for a bigger sucker to come along and take it off his hands?

Maybe it will go the same place Airstream Central went.

Why don't you call the number he gave you. If it's his business number, you can hang up. If it's his home number, call back in the middle of the night to discuss the terms of him "renting" your photo. Of course you can always use the high road and report him to both Airstream, Inc., E-bay, and to the Better Business Bureau.

G - Looks like he has switched photos -- to another from the same photo rotation on your homepage!

It looks like he's arguing with somebody on his own sale page. "Well your wrong, I own the domain name and I also own Thorcampers.com and also ThorRVs.com and Thormotorhomes.com and Thorfifthwheels.com at one time I..." In my garage law office my first word of advice is don't give away more than you're asked. Don't know if he's cybersquatting until he actually sells something -- which should come in 5 days and 7 hours. Free bottle of snake oil included.

It would appear the value of the first sold Thor domain name will be diluted X 4 when he sells all the rest. SaabLover, you're lucky you aren't out yer $75.

Don't forget to save files AND hard copy of his page/s that you have taken affront to! Nothing is worse than going back to get the page if you need it for legal wranglings, etc. and he has changed it!

I just got off the phone with him...he is removing all of my pics from his ad!!!!

He still tried really really hard to sell me the domain and I am just not interested...

He did say he had someone call that purchased an Airstream trailer and was not happy with it...wanting to purchase the Domain for a "Hate" site...

Anyway, he did tell me he was changing the photos so we will see.

From what little research I have done he is in definite violation of the Anti-Cybersquatting Act and is violating Federal law. Airstream should have no problem getting the domain back under that act. And the cost is surprisingly low ($1,100, I believe)--no huge attorney fees as he says on one of his answers.

"The Anticybersquatting Act was enacted by Congress specifically to address the practice of snapping up famous marks or names as Internet domain names. The legislative history of the Anticybersquatting Act reveals that it was created with the awareness that sophisticated cybersquatters take precautions to avoid liability such as to circumvent offering the domain name for sale in a manner which violates current law. Therefore, under the Anticybersquatting Act, mere bad faith registration of the domain name is sufficient. The Anticybersquatting Act provides that the bad faith registration, trafficking or use of a domain name violates federal law. "

"The Anticybersquatting Act generally applies to domain names identical or confusingly similar to marks that were distinctive or famous when the domain name was registered, and includes personal names. The marks covered by the statute need not be federally registered (i.e., a protectible right can be established by showing use), and include celebrities' names. In order to prevail under the Anticybersquatting Act, the rightful owner must prove bad faith intent on the part of the cybersquatter by factors including: the fame or distinctiveness of the mark involved; whether the cybersquatter has trademark or other intellectual property rights to the name (for instance, whether the name is his or her legal name or nickname); the cybersquatter's prior legitimate use of the name versus an intention to divert consumers to another web site which could harm the trademark owner's goodwill; the cybersquatter's offer to sell the mark for financial gain; provision of false contact information; and patterns concerning these factors, particularly the registration and sale of multiple famous domain names."

No matter whether he is trying to sell the name to "Airstream dealers" (which he does not say is a condition on his site and lists no conditions upon the sale as such), it appears all he is trying to do is capitalize on Airstream's name to make money for himself. Bad faith!! Go go Airstream lawyers!

(His story might fly a little better if he wasn't selling the Rudy G. domain--was he planning on starting a fundraising company for Rudy??)

I was thinking about the cybersquatting laws, wasn't sure if it had passed or not....either way, he's got a fun run ahead of him..... he has simply stolen another pic as G said from an Airstrem stock photo. Bottom line, man has issues, both personally and soon, professionally.
