Exclamation Save Leo & WBCCI Defense Fund

I need not repeat thee details of how for no real reason Leo G was ousted from the club for expressing his opinions.

And now the IP openly says if he wins his appeal a new grievance is waiting in the wings its time to get this and all the other issues discussed about the way the ancients are miss managing the club not meeting the needs of the members.

Ignoring it's Constitution, bylaws & Roberts Rules.

LEGAL DEFENSE FUND


Leo reinstated
Lack of fiscal responsibility
etc.

With about $7500 we can get the ball rolling in Federal Court in NY

A paypal trust account could be setup to accept contributions.

I would like to gauge interest in taking the club to Court.

Remember if we do nothing it is likely there will not be a club at the burn rate of the treasury.

Or you can have a grievance against you just like Leo.

Leo should leave the WBCCI,the reason why I am leaving the WBCCi, is the gluttony of money problems ,why create more money problems.TAC is the answer,if I am not welcome in the wbcci then ,I go to TAC.

Wait a minute! Leo has an automatic appeal which is going to take some time. Tom C ALREADY knows of a standby grievance!
That would mean that somebody has written one AND Tom has seen it, or that somebody said they would write one and Tom knows about it or even that Tom himself will write one. In any event, they are once again are not playing by the rules they make up. I thought grievances are private???

So far myself, Wheel Interested , Whitesend, and RichDavis have stated they will support this fund.

I am hoping to contact LI Pets and set up a separate tread were members can sign in just with their pledges. At his time no money will be collected until Leo states he is willing to go for it. After that an account will be opened and in the event more monies are collected than actually spent money would be returned based on the percentage each member pledged.

It is no longer time to wait for the IBT to react. Time has always been on their side it is time to force the issue and bring them out into the light of day. The tactics they are using are clearly nothing more than harassment. So far they have threatened 3 members by using their Super Secret Grievance Policy. If nothing else lets force them to exhibit that in open court.

This is where my Dues are going to be spent and I am going to have a say in the control of hat expenditure rather than sending more money down the IBT sink hole.

I would invite any and all who have dissatisfaction with any aspect of the WBCCI operation to support this fund.

90+% of the general membership have no idea what has taken place, where the money is going, or who is being singled out for punishment. It time we opened this up t the point it gets their attention.

I pledge $100.00 from Colorado to the Leo Garvay (sic) Defense fund. Leo clearly sees why the WBCCI is being derailed from membership growth and fiscally responsible tracks. He sees how to get it back on track. The WBCCI Executive Committee (EC-7) has no rational response to and no logical arguments against Leo's correct observations. If they did, they would have made them.

Because they cannot refute him or win on the merits of their actions, the Excommunications Committee has decided to throw Leo out of the club. That won't change anything because the EC-7 will continue to mismanage our club and run it into the ground. Change from within is impossible because the EC-7 always nominate their like-kind successors through their puppet Nominating Committee. Because they know they very well may loose a fair and open election based on rational dialogue and declared policy positions, the EC-7 over the past 5 years has opposed and defeated each and every member-sponsored change to voting procedures for national office. Needed changes are discarded by being shuttled off to the 2020 Committee, where along with many other great ideas they are relegated to die.

God save the WBCCI because the EC-7 and IBT certainly won't.

For the benefit of us non legal types, can anyone answer the following?
What statutes would the wbcci or officers be accused of violating from a legal standpoint.
Why would this be a federal court filing instead of in some state, like ohio or NY

The underpinnings should not be made public IMO

Leo is a resident of NY he has no reason to go to Ohio, why would he want to be on their turf.

He was a member of Metro NY

New York's Courts, the Second Circuit sets many presidents in law as does several other circuits, Ohio not so much. A different level of Judges located in larger cites.

The law firm that was contacted has experience in club matters.

He will work with us money wise.

If constutional or Federal laws (Also WBCCI is sending out a lot of trademark infringement letters if this needs to br decided it can only be done in Federal court.)come into play you must be in Federal not State Court, moreover, when the WBCCI has to hire a firm to defend they will likely not use their Ohio contacts they will need a local NY firm $$$$

Although I'm speaking here about Leo this is really not so much about him but all of US the general membership.

All the issues would be included in such a suit that he has brought to light.

So...the plan is to have the club membership sue the club leaders? And this will somehow resolve the financial situation WBCCI is in?

I'm sorry - this lawsuit doesn't make a lot of sense to me, even after reading this thread twice. Could someone please explain it again? It seems, even if this potential lawsuit is successful, you still have many of the same problems in WBCCI...now with higher dues to pay the legal bills.

Why not instead collect money to help start a new club?

IMHO: A court of law enforces justice -- clearly, precisely and within limits.
If one think the rules and policies of a club are legally unfair one might have a difficult argument. Be prepared.
A fraternal or social club, or a religious group unlike justice does not have precise limits.

Once you start, where will you stop?
Once the lawyers get involved where will they stop?
Once the law gets involved where will the law stop?
What is your event horizon?
Risks vs. benefits?
How deep are your pockets?

I don't know if this is the best way to proceed.
What does Leo say? Others must know.

No I think its about trying to show the IBT that the members no longer support their representation and actions. Going outside the WBCCI is the only way those members who would like some satisfaction, win or lose, can make a statement. That is my opinion of what is happening. The defense is for member rights and the objection to the subjectivity and bias of the leadership and their dereliction of duties and their misappropriate actions.
