Thumbs up Leo's verdict is in

For those of you that have been following the grievance against Leo, I just saw this at his site:

The International Executive Committee met November 11, 2008 in special session and concurred with the Ethics and Grievance Committee's recommendation. Therefore this grievance is hereby dismissed and closed.

Exclamation Leo Garvey - Grievance Dismissed & Closed

The WBCCI Ethics and Grievance Committee reviewed the circumstances of the above subject, found that Mr. Garvey violated the Code of Ethics and recommended that he should abide by the Rules of WBCCI, especially the Code of Ethics.
Due to the fact that the date and place of the alleged violation,
or misconduct, was not included in the subject grievance as required by the Reference which states;

"A complaint so filed, shall be in writing and shall state the date and place of the alleged violation or misconduct and the facts upon which such complaint is based.
"
the Ethics and Grievance Committee recommended this grievance be dismissed.
The International Executive Committee met November 11, 2008 in special session and concurred with the Ethics and Grievance Committee's recommendation. Therefore this grievance is hereby dismissed and closed.

Based on the evidence I don't believe that Leo violated the Code of Ethics, but it just needs to end here.

Too be clear the EGC did not identify this fatal error in the missing date of the complaint, it was found by a lot of work by Leo and myself studying the rules.
Thereafter, objecting to it.

Leo has dealt with this for about 5 months, it is now over for him and his wife.

He remains a valuable contributing member in the the Metro NY unit.

Moreover, he is the 2008/2009 President.

I trust everyone has learned from not only this issue but that of Bob Thomson.

Now let's move forward and change what needs to be changed with this club.

The most important thing IMO is the IBT and all PP's etc is to respect everyones freedom to express their opinions, not bring forth frivolous grievances.

Good IBT judgment results in excellent news!

It's very rewarding to see the Ethics Committee recommendation to dismiss, and to see the IBT exercise sound judgment in dismissing, Jim Franklin's grievance against Leo. Now our leaders hopefully can and will focus their attention and efforts on continuing to build this club while listening to new ideas and suggestions from many different members. It's nice the IBT quickly put this dark episode behind us.

Congratulations Leo! You are now free to continue leading the solid growth in fun and adventure at the Metro N.Y. Unit. Wally on!

Now that everyone is celebrating, I wonder how much of this was a result of doing the right thing or a result of massive member protest. I do not think most clubs members realize how many emails, phone calls, and letters went out in support of both Bob Thompson and Leo Garvey. I am not sure we know the full extent of how many people resigned due to this. I sure hope this acts as the catalyst to spurn the everyday members to step up and participate more. I sure hope we can grow from this and make this club exactly what it's members want.

Pressure may have played a part in Bob T's reversal, but not so much in Leo's case.

We had them cold in Jim Franklin's fatal error of omitting the date and place.
The ECG first indicated that the date was on the exhibit attached to the complaint so that was not an issue.

However upon review the error was upheld requiring the dismissal.

If they had not dismissed the complaint we were fully prepared to bring the case before a Federal Court.

While I'm not 100% satisfied because they found Leo had violated the ethics, they should not have considered a complaint that was invalid on it's face.

It's up to Leo if he he wishes to appeal that part of the decision which he is entitled to do.

I'm not sure if this has already been addressed here, but has anyone ever considered filing a grievance against Jim Franklin?

If ANYONE has violated the mumbo jumbo wording of that Article - ie been the direct cause of so much dissention within the Club - just seems like the perfect application of the intent of the Article. Or, to put it another way, just who is it that has caused the more damage and loss of membership to our Club?

A grievance was filed. It was dismissed on a technicality, coincidentally creating a nice precedent for Leo's dismissal on a technicality. . .
