There is always risk of nuisance lawsuits, but that is all it should amount to. Canadian and US laws are remarkably similar in this respect.
Actually, the information I shared in my previous post is per discussion with a lawyer. I know you have spoken with a lawyer as well, hence my comment on US and Canadian laws being different on this.

The last time I discussed risk with my lawyer he suggested we stay in bed in the morning, unless we want to live our life. We choose to live.

I spoke with a law firm with knowledge of both jurisdiction.

The worst case scenario I was made aware of was "wilful negligence". But here's the catch: wilful negligence has to be proven. And in the presence of a professionally set up hitch and the absence of engineering standards governing the setting of tow ratings (with known exemptions) that is nay impossible.

Add to this a good personal liability insurance and I am sleeping well at night.

I couldn't have put it better myself. Thanks Andy.

I tow the '19' FC with a Pilot. A bit under powered for CO mountain passes, but otherwise fine. fuel economy drops from 22mpg hwy to 13-14 , so you can tell it's a bit underpowered . Make sure you take into consideration altitude towing discount.
