So, anyone up on patent law? Is it possible that there is only an appearance patent and the black color gets around it. The next question is, who owns the patent and who is paying a license. And the elephant might well be, is there a patent.
Like the paint them black solution. Like the idea of branding them with the Defacer2018 logo and circle/slash. Find the recycle approach is quite effective and appropriate to flush the flawed relationship. Pat

What exactly would be the trademark? The arch itself? Is there a TM symbol on the arch registering it as a trademark?
Under what legal theory would there be a violation of the Lanham Act here?

Maybe it was tongue-in-cheek when I wrote it.
But why doesn't the National Park Service, the BLM, your state, or the Federal Government place copyrights on our national treasures?
It could provide a method for civil action and damages against a defacer.
Would some lawyer provide an opinion?

My my what a vindictive bunch. I have never defaced a national landmark but have certainly done my share of stupid things in my life. I certainly think he should be punished but I won't be the one to cast the first stone at him.

Your thought is not new, but there was an unintended consequence, which is quite frustrating. The NP contracts, at least at Yosemite NP, passed the rights to the names of lodges and similar facilities to the managing vendor when those functions were outsourced. There was legal action to reverse the contract, but in the near term the names in the Yosemite park were changed when the managing vendor was replaced so they would have no basis for damage claims from the use of the traditional names. So, there are some trademarks. It's just not everything on public lands and in at least one case, ownership proved more difficult that anyone would imagine. Pat

BIG mistake, but..
No doubt the guy made a BIG mistake and set a horrible example for his kids, but who among us hasn't done something stupid without thinking? (Let the person who has never done something stupid cast the first stone.) In the past, without social media, how many of us could have done something that, in retrospect, could have cost us business, a reputation, public shame, ect? Probably a lot. I just think that ruining his business with boycotts and taking away his way of providing for his family is not right, either. It was stupid, of course, but I think he is going to pay for it in plenty of ways without taking away his family's financial security. Just my opinion.
